A. GENERAL DATA PRIVACY POLICY 

Philosophy

All our services are based on the fundamental pillars of trust and security. This also applies to your personal data, which we store and process only within the legal limits (GDPR) and only to the extent necessary to fulfill our contracts. We constantly examine whether the storage of your data is still necessary and delete or anonymize it whenever this is possible.

DATA STORAGE and PROCESSING

Your personal data (such as Name, Address, E-Mail, Telephone Number,…) will only be stored and/or processed regularly if we have the need to do so. As a rule, this occurs in the course of order fulfillment, the provision of services or in the context of legal obligations. In detail but without claiming to be exhaustive, the following legitimate interests may be the basis for data processing: 

 - Processing of orders, inquiries             - support purposes
 - Delivery of products and services        - Marketing, communication
 - submission of offers                              - Legal obligations

In addition to or parallel to the storage/processing of your data on the basis of a legitimate interest, we process your data on the basis of your declaration of consent, which you have actively provided to us. This also applies to the disclosure of your data to third parties.

You may at any time withdraw your consent, ask for rectification and/or ask for information about all personal data stored by sending an informal note to privacy@copadata.com. Following a withdrawal we will delete or anonymize all your stored personal information to the extent possible. The withdrawal of consent does not affect the lawfulness of any data processing based on consent before its withdrawal. Every deletion or anonymization is subject to lawfulness and will only be carried out if the personal information is not required for the performance of tasks in accordance with legal provisions. In such cases the retention period depends on the respective processing purpose.

COPA-DATA will transfer personal data only for the purpose of data processing in the way described above but will never share any personal data publicly or with third-parties, except when required to by law. When storing and processing your personal data, we only use GDPR-compliant software and service providers, which we regularly check for compliance with the standards.

LOCATIONS of DATA PROCESSING

Your data will only be passed on to third parties like Sub-Processors with your prior consent, if there is a legitimate interest or if there are legal obligations. We regularly process your data within our group of companies or share it with our subsidiaries listed hereunder:

If a data recipient or processor does not have its registered office within the scope of the GDPR or is classified as a “safe country” in accordance with the provisions of the GDPR, the transfer of data is always carried out in compliance with and after conclusion of the Standard Contractual Clauses in accordance with Regulation (EU) 2016/679 of the European Parliament.

STORAGE TIME

In consideration of the protection and sensitivity of the personal data processed, we only store or process it for as long as is absolutely necessary due to the legal conditions or to fulfill our obligations. In order to meet this requirement, we regularly review our processes and make improvements to them whenever possible. If you no longer use our services or the reasons for processing your data no longer apply, we will delete your data or, if necessary, anonymize it in such a way that it can no longer be linked to you personally.

DATA SECURITY

In order to protect your personal data we conduct regular security audits to identify vulnerabilities, have implemented access controls and encryption of data in transit and at rest. Please mind that in our modern world 100% secureness cannot be guaranteed but we strive to do the best to keep your data safe.

THIRD PARTY SOFTWARE

We use third party software to save and process your personal data. The storage and processing of personal data using third party software is carried out like any other data processing in compliance with the GDPR. We use the following third party software:

HubSpot: We are using HubSpot and HubSpot Forms which is a tool from HubSpot that is used on websites and shops to provide forms for various purposes such as contact requests, newsletter registrations, registrations for webinars or downloads of resources. The processing includes the collection of personal data entered by users in the forms. This data is used to process inquiries, support marketing and sales activities, personalize communications and improve the user experience. HubSpot Forms also makes it possible to track and analyze user behavior in order to better understand how users interact with the website and the content provided. Data may be transferred to the USA and other countries in which HubSpot operates. Appropriate data protection measures are taken in accordance with the EU standard contractual clauses. AI Assistant (Chatbot): Our website offers the assistance of an AI-based chatbot, which you may see in the bottom right-hand corner from time to time. By using the chatbot, you agree that your input information will be processed by us.. You also agree to session cookies being saved for 24 hours, which gives you the option of continuing a chat within this timeframe after leaving the website.

B. Special provisions for COPA-DATA WEB services

For the convenience and education of our customers COPA-DATA offers various Web Services to which you will gain access by Single-Sign-On after your registration. Due to their nature the use of some of these services is subject to special provisions which you will find hereunder. You will only be granted access to the COPA-DATA Web Services if you accept these provision.

With this Special Provisions we would like to inform you as our customer about the type, extent and purpose of the collection and use of personal data during the use of the zenon Engineering Assistant (in the following “EA”). To be able to use the EA you need to agree to the terms of this privacy policy. You can revoke this statement at any time by sending an informal note to privacy@copadata.com

 

DISCLAIMER

 

You may only use this EA if you are currently logged in to our website services. All information, questions or texts you enter in the EA interface are linked to your user account, which refers to your e-mail address. The data from the input mask is transmitted to the EA. The EA automatically provides answers on topics relating to the zenon software platform and COPA-DATA services. The EA may not be used for information beyond these topics.

 

Please mind that the answers provided by the EA may be incorrect, merely serve as initial information and are not binding in any way. The use of the EA and the implementation of its recommendations is at your own risk. In doubt always get in touch with COPA-DATA´s customer support. COPA-DATA assumes no liability for damages resulting from the use of the EA or from the implementation of the EA's responses.

 

DATA PROTECTION RIGHTS

 

The input text will be stored together with your personal information locally at COPA-DATA. The input text without link to your user account will be processed to an external API for answer generation. In both cases, the data can be analyzed by human beings in order to evaluate customer needs and improve the EA's capabilities.

If you provide the EA with personal data like insurance number, your name, date of birth, etc. and if this information can be used to draw conclusions about your health status, your gender, your sexual orientation, ethnicity and/or other sensitive information about you, your consent to this Privacy Policy also applies to this information.

 

You can at any time withdraw your consent, rectification and/or ask for information about all personal data stored by sending an informal note to privacy@copadata.com. Following a withdrawal we will delete or anonymize all your stored personal information to the extent possible. The withdrawal of consent does not affect the lawfulness of any data processing based on consent before its withdrawal. Besides, the link between your submitted data and your user account will be deleted after 6 months. Every deletion or anonymization is subject to lawfulness and will only be carried out if the personal information is not required for the performance of tasks in accordance with legal provisions. 2. COPA-DATA Community Forum

 

The COPA-DATA Community Forum serves to encourage the exchange of information and experience about the zenon software between forum users respectively zenon users. It is hosted and moderated by COPA-DATA. By using the Community Forum, you agree that your personal data will be stored and processed permanently, and that, besides the moderators, only you can delete content that you have created and submitted.

Please mind that any published information on the Community Forum is the subjective opinion and view based on the experience and the level of knowledge of the author. COPA-DATA does not overtake any responsibility for the content and the accuracy of the shared information.

 

Users of the Community Forum are encouraged to share only well-founded experiences and to point out any risks associated with the implementation of proposed solutions to problems. 

 

COPA-DATA at its absolute discretion, reserves the right to moderate the forum. In this connection COPA-DATA may remove any information containing false facts, potentially dangerous solutions, bad language or content that may insult, degrade or discriminate others. COPA-DATA may block a non-complying user from forum access if the user violated this provision.

D. FINAL PROVISIONS

COPA-DATA reserves the right to amend this privacy policy from time to time at its sole discretion. In case you are a registered user with Login to our Services we will inform you accordingly of such changes. You may then disagree with such changes in writing. In case you disagree with the changes COPA-DATA reserves the right to disable your account.

This agreement shall be governed by Austrian law to the exclusion of international conflict of law rules. The place of jurisdiction for all disputes arising from and in connection with this non-disclosure agreement is the competent court in Salzburg/Austria.
